B. Phase Program

PHASE PROGRAM OF PARCEL RE-SUBDIVISION AND INSTALLATION OF OFF-SITE IMPROVEMENTS

To provide for the orderly growth of Pueblo West, each subdivision and lot and parcel therein will be classified under one of the following defined Phases and shall be improved under the time schedule and conditions provided thereunder:

PHASE I

All subdivisions and lots and parcels therein classified in this category shall have water distribution lines and improved streets installed in accordance with a scheduled improvement program spanning the years 1969 thru 1979.

PHASE II

At any time after January 1, 1980, the owner of any lot or parcel of land classified in this category may elect to re-subdivide his lot or parcel in accordance with the zoning and master plan on file with Pueblo County.  All arrangements for the extension and installation of off-site  improvements and utilities shall be made by the lot owner in accordance with existing rules and regulations of the Pueblo West Metropolitan District and to comply with the applicable laws and regulations of any governmental agency so concerned with the re-subdivision of the lot or parcel.

In the event the lot owner chooses to occupy lot or parcel prior to above date, the owner shall make provisions to drill his own well or otherwise provide for domestic water supply and provide for his own utility extensions. Prior to drilling any well, the owner shall obtain approval and permits from the Pueblo West Metropolitan District and to comply with the requirements of any other regulatory agency.

PHASE III

At any time after January 1, 1985, owner of any lot or parcel of land classified in this category may elect to re-subdivide his lot or parcel in accordance with the zoning and master plan on file with Pueblo County.  All arrangements for the extension and installation of off-site improvements and utilities shall be made by lot owner in accordance with existing rules and regulations of the Pueblo West Metropolitan District and to comply with the applicable laws and regulations of any governmental agency so concerned with the re-subdivision of the lot or parcel.
